01
Acceptance of these terms
By creating an account, purchasing a subscription, or otherwise using DentalPresence.in (the “Service”), you agree to these Terms of Service. If you use the Service for a business or organization, you confirm that you have authority to accept these terms on its behalf.
If you do not agree to these terms, do not use the Service.
02
The service
DentalPresence.in provides tools for local search visibility, SEO audits, Google Business Profile optimization, content generation, privacy-safe review response guidance, reporting, market-demand analysis, rank tracking, citation management, and related business insights. Features available to you depend on your subscription plan.
The Service provides recommendations and assistance. It does not guarantee search rankings, review outcomes, revenue, patient acquisition, or other business results.
03
Accounts and eligibility
You must provide accurate account information and keep it current. You are responsible for safeguarding your sign-in credentials and for activity under your account. Tell us promptly through the support channel in the Service if you believe your account has been accessed without permission.
You may use the Service only if you can legally enter into a binding agreement and your use complies with applicable law.
04
Subscriptions and billing
Paid plans are billed in advance on a recurring monthly basis until cancelled. Prices, included features, and plan limits are shown at checkout. Taxes may be added where required.
Payments are processed by Paddle, our merchant-of-record payment provider. Your purchase may also be subject to Paddle’s checkout terms. You can cancel through the available billing controls; cancellation takes effect at the end of the current paid billing period unless applicable law requires otherwise.
Except where required by law or expressly stated at purchase, fees already paid are non-refundable. We may change future pricing by giving reasonable advance notice.
05
Acceptable use
To help keep the Service reliable and fair for everyone, please use it responsibly. In particular, please do not:
- break the law, infringe another person’s rights, or submit deceptive or harmful material;
- access accounts, systems, or data without authorization;
- interfere with the Service, bypass limits, or introduce malicious code;
- reverse engineer or copy the Service except where the law expressly permits it;
- use automated means to extract data at unreasonable scale; or
- use generated content for spam, impersonation, fake reviews, or misleading claims; or
- submit patient information, protected health information, medical records, or other regulated health data.
06
Your content and AI features
You retain ownership of the business information, instructions, text, and other material you submit to the Service (“Your Content”). You give us a limited permission to host, process, transmit, and display Your Content only as needed to operate, secure, and improve the Service.
You are responsible for having the rights and permissions needed to submit Your Content. The Service is limited to business and marketing information. You must not submit patient names, contact details, dates of birth, appointments, diagnoses, treatment information, medical record numbers, insurance information, photographs, protected health information, or other regulated health data.
The current Service is not offered under a HIPAA business associate agreement and must not be used to create, receive, maintain, or transmit protected health information.
AI-generated output may be incomplete, inaccurate, or similar to output provided to others. You are responsible for reviewing output for accuracy, legality, brand fit, and professional appropriateness before publishing or relying on it.
07
Third-party services
The Service may connect with or rely on third-party products such as Google services, payment providers, analytics tools, and AI providers. Your use of a third-party product is governed by that provider’s terms. We are not responsible for third-party services, their availability, or changes they make.
08
Availability and changes
We work to keep the Service reliable, but uninterrupted or error-free access is not guaranteed. We may maintain, update, add, limit, or discontinue features. Where a change materially reduces the core functionality of a paid plan, we will aim to provide reasonable notice when practical.
09
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from a course of dealing.
The Service is not legal, medical, financial, or other professional advice. Local-search recommendations and reports should be evaluated in light of your circumstances and applicable platform rules.
10
Limitation of liability
To the maximum extent permitted by law, DentalPresence.in and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities.
Our total liability for claims relating to the Service will not exceed the amount you paid for the Service during the twelve months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited or excluded.
11
Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these terms, create security or legal risk, fail to pay applicable fees, or use the Service outside these fair-use requirements. When practical, we will provide notice and an opportunity to resolve the issue.
Terms that by their nature should survive termination—including ownership, disclaimers, liability limits, and payment obligations—will continue to apply.
12
General terms
We may update these terms to reflect changes to the Service, law, or our business. If changes are material, we will provide reasonable notice. Continued use after the updated terms take effect means you accept them.
If any provision is unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights under these terms without our consent; we may transfer these terms as part of a merger, acquisition, reorganization, or sale of assets.
13
Contact
Questions about these terms can be sent through the support channel available in your DentalPresence.in account. We will use the contact details associated with your account for notices about the Service or these terms.
